ADMINISTRATIVE ORDER No. 16-7
Collection of Restitution by Juvenile Probation
PURSUANT TO 705 ILCS 405/5-305 (PROBATION ADJUSTMENT)
WHEREAS, the State of Illinois has enacted 705 ILCS 405/5-305 authorizing probation adjustments for minors; and,
WHEREAS, a probation adjustment authorizes the Probation Department to confer a preliminary conference with a minor and his or her parent(s) and where appropriate devise an informal supervision adjustment plan which may include any conditions of probation provided in 705 ILCS 405/5-715; and...
WHEREAS, the conditions of probation include making restitution under the terms of subsection (4) of 705 ILCS 405/5-710;
WHEREAS, these matters pertain to juveniles and are authorized by the Juvenile Court Act, Circuit Clerk will assign these cases a Miscellaneous Remedy (MR) case number and the confidentiality of court records will be enforced and these files will be impounded by the Circuit Clerk's office;
WHEREAS , the matters pertain to juveniles, these cases will be assigned to the sitting Presiding Judge of Juvenile Court.
NOW, THEREFORE, IT IS HEREBY ORDERED that the Circuit Clerk shall receive restitution paid by minors pursuant to a informal supervision adjustment plan from the Probation Department and the Circuit Clerk shall forward said restitution payments to the named victim I recipient.
